The products offered are those presented on this merchant site and which are accompanied by a detailed description. These products are offered within the limits of available stocks and as long as they are visible on the site. In case of unavailability of the product after placing the order, BIYANE will inform the buyer by email: the order will either be modified with the buyer's agreement or canceled and no debit will be made.

• PRICES

The prices appearing on this merchant site are understood to include all taxes (VAT + other applicable taxes) excluding processing and transport costs which are applied and detailed when ordering. BIYANE reserves the right to modify its prices at any time: the products are invoiced on the basis of the prices in force at the time of the validation of the order, subject to availability. THE PRODUCTS REMAIN THE PROPERTY OF THE SELLER UNTIL FULL PAYMENT OF THE PRICE.

• ORDERS

The buyer who wishes to purchase a product online via the site must follow the online ordering process which includes an identification phase, a verification and validation phase for the products chosen, a payment phase under the conditions provided and a confirmation phase of the order and payment. The confirmation of the order entails the acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions. All the data provided as well as the recorded confirmation will constitute proof of the transaction. BIYANE will send confirmation of the recorded order by email, which will constitute acceptance of the order.

• PAYMENT

 

The price is payable when ordering. Online payments are made by secure system so that no third party can access the data transmitted on this occasion. Debits are made upon validation of the order. The customer has the option of paying by credit card or paypal.

• DATA SECURITY

The BIYANE site does not store any payment data concerning the Customer, thus eliminating any possibility of fraud by hacking the site. The bank details are transmitted in one go when paying by credit card by phone via the e-paypal terminal ensuring security against fraud. BIYANE does not keep any information concerning the credit card numbers of its customers.

• WITHDRAWAL

 

Non-professional buyers have a withdrawal period of fourteen days from the delivery of their order to return (re-shipment costs at their expense) the product to the seller for exchange or refund without penalty. Returns must be made in full original condition (packaging, accessories, instructions, etc.) allowing them to be remarketed in new condition and accompanied by a copy of the purchase invoice.

• GUARANTEES

 

All products and services provided benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance, it may be returned to the seller who will take it back, exchange it or reimburse it. All complaints, requests for exchange or reimbursement must be made according to the methods specified on the site, with a reasoned complaint and copy of the invoice, within thirty days of delivery.

It cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus interruption of service or other involuntary problems, as well as any fact qualified as force majeure. The photographs accompanying the products are provided for illustrative purposes but cannot ensure perfect similarity, particularly with regard to colors. In case of doubt or for any further clarification, it is advisable to contact the seller.

• LITIGATION

 

These general conditions of sale are subject to French law. The language of this contract is French. In the event of a dispute, the French courts will have sole jurisdiction.
